1. Preamble
These General Terms and Conditions of Sale (“GTC”) govern sales made by Arduenna Spirit Company, located at 72 Poisson-Moulin – 6640 Vaux-sur-Sûre, registered under number BE 0764 422 950. By placing an order on our website, you expressly accept the GTC in force at the time of the order. These GTC may be modified at any time, with the applicable version being the one published at the date of the order. Last updated: 26/09/2024.
2. Products
The products offered for sale are described on our website in a precise and detailed manner, in accordance with Article 6 of Directive 2011/83/EU. Photographs are provided for illustrative purposes only and are not contractually binding. Arduenna Spirit Company guarantees the accuracy of the descriptions.
3. Prices
The prices of products are indicated in euros (€), inclusive of all taxes (VAT included), based on the applicable rate at the time of the order. Applicable shipping costs are specified before the final order validation. In the event of an obvious pricing error, Arduenna Spirit Company reserves the right not to honor the order. Products will be invoiced based on the rates in effect at the time of final validation of the order.
4. Ordering
The ordering process includes the following steps:
- Selection of products
- Validation of the cart
- Filling in personal and shipping information
- Secure payment
Before the final validation, you can review and correct any errors in your order, in accordance with Article 16 of Directive 2011/83/EU. We reserve the right to refuse any order for legitimate reasons, including in cases of suspected fraud.
5. Payment
Payment is made via the secure payment methods available on our website, in compliance with Regulation (EU) 2019/518. Orders will be processed upon confirmation of full payment. All online payments are secured using encryption protocols that meet the highest standards.
6. Delivery
Products are shipped to the address provided during the order process. Delivery fees are calculated based on weight and destination. We commit to respecting the delivery times indicated (usually between 3 and 5 business days for Belgium). If a product is not delivered within 30 days of the order, in accordance with Directive 2011/83/EU, you have the right to terminate the contract and obtain a full refund. Delivery-related risks are transferred at the time of receipt of the products unless you have chosen a carrier other than the one offered by Arduenna Spirit Company.
7. Right of Withdrawal
In accordance with Directive 2011/83/EU and the Belgian Code of Economic Law, you have 14 calendar days from the receipt of the products to exercise your right of withdrawal without justification. To do so, you must inform us via the withdrawal form available on our website or by email at info@arduenna-gin.com. Products must be returned in their original condition, complete and undamaged. Return costs are at your expense unless the product is defective or does not conform to the order. Refunds will be made within 14 days of receipt of the returned products.
8. Exclusions to the Right of Withdrawal
In accordance with Article 16 of Directive 2011/83/EU, the right of withdrawal does not apply to:
- Perishable goods,
- Sealed goods for hygiene or health protection reasons, if the seal has been broken after delivery,
- Goods made to your specifications or personalized.
9. Warranty and Compliance
All our products are covered by the legal warranty of compliance in accordance with Directive 1999/44/EC and the Belgian Code of Economic Law. In the event of a defect or non-compliance, you have two years from the receipt of the products to request a replacement, repair, or refund. Defective or non-compliant products must be returned with proof of purchase.
10. Personal Data Protection
In accordance with Directive 2013/11/EU, you may refer to an independent mediator to resolve any disputes amicably. The designated mediator is Consumer Mediation Service, reachable at:

If no amicable agreement is reached, the competent courts will be those of Neufchâteau. You can also use the Online Dispute Resolution (ODR) platform of the European Commission, available at: https://ec.europa.eu/consumers/odr.
11. Mediation and Dispute Resolution
In accordance with Directive 2013/11/EU, we offer the possibility of using an independent mediator to resolve any disputes amicably. You can contact our authorized mediator at [Name and Contact of Mediator]. If no amicable agreement is found, the courts of Neufchâteau will have jurisdiction over disputes related to these GTC. You may also use the European Commission’s Online Dispute Resolution (ODR) platform via this link [ODR link].
12. Applicable Law and Liability
These GTC are governed by Belgian law. In the event of a dispute, the courts of Neufchâteau will have sole jurisdiction. Arduenna Spirit Company cannot be held responsible for non-performance of the contract in cases of force majeure, as defined by Belgian law. Arduenna Spirit Company’s liability is limited to the value of the products ordered and delivered. Under no circumstances shall we be liable for indirect damages.
If any clause of these general terms is declared null or unenforceable, the other clauses shall remain fully valid and applicable.
